Christine Leach, the mother who police say drove her car into a moving train in October, had her hearing delayed to January by a judge in Stockton court today.
Leach, 43, has been deemed competent to stand trial after her lawyer, Gregory Davenport, asked that she be medically evaluated in November. Leach is charged with attempted murder of her 5-year-old daughter and child endangerment after she drove her white Chevrolet Malibu into a Union Pacific train in Lodi on Oct. 7.
Davenport said he is pushing to try to have Leach put into a care facility that would also provide counseling, rather than incarceration.
He said having Leach behind bars is not helpful to her, and that counseling is the best option for her.
Leach is scheduled to appear in court again on Jan. 19, 2012.
