I think it was a warning shot. But that idiot ran in front of the bullet. You cannot blame Gary for that!

lets consider bigger picture here, People like Driggers bring bad name to our troops when they serving overseas. He is more than likely to engage in un acceptable behavior while serving. What kind of example our police and DA are setting here by not arresting him and not prosecuting him to the fullest extent of law or turning him over to military. Yes , he is petty thief but consider bigger picture and example being set here. Other petty thieves will think, its not bad, enjoy stolen beer and send the store clerk to jail if he takes any action.
On the other hand, I agree that Clerk used excessive force. May be a warning shot in the air would have sent the same message to thieves and gangster and he would have stayed out of trouble.
Both deserve some punishment for their actions, But In my opinion Drigger should be held to higher standards, I wonder what he will do when he is BOLD drunk with stolen beer.
