A December jury trial has been set by a Sacramento Superior Court judge in the lawsuit filed against the city by its former parks and recreation director.

Boyce Jeffries, who had been employed with the city since 1984, was among three employees who were 50 years of age or older to have their positions eliminated last year. The city also eliminated its community development director position and a police sergeant position, although that person was able to apply for an officer position.

Jeffries claimed in his lawsuit filed last December that he was laid off due to age discrimination, an assertion the city has denied. Instead, it said, the decision was made based on funding.

Mediation was not an option as the city made a pre-suit offer of early retirement to Jeffries which far exceeded the city's current evaluation of the settlement value of this case, according to its outside counsel.

Instead, Jeffries rejected the offer and filed the lawsuit, forcing the city to incur significant attorneys' fees, attorney Serena Sanders wrote in a June 4 letter to the court.

The case was last heard in court June 21. Both parties requested a jury trial.
