Lodi Unified School District cuts the second-highest district position

Board President Richard Jones says Restructuring is in board's future

In what may have appeared to be a secret, closed-door session Monday night, the Lodi Unified School District board eliminated the district's associate superintendent position and reassigned Odie Douglas to another not-yet-known administrative position.

A separate resolution does not re-employ Bill Atterberry as assistant superintendent of secondary education, also reassigning him to another administrative position within the district. Until last fall, he was the principal at Lodi High School.

Board president Richard Jones said trustees are looking at possibly eliminating Atterberry's current position, as well.

There is a chance Douglas could be moved into the assistant superintendent of secondary education role and take on both those duties, as well as those of his current office, according to Jones.

It is not yet clear whether there will be a cost savings to the district. Last school year, Douglas earned $164,275, while Atterberry was appointed in September to his new position and annual salary set at $135,421.

The decisions are apparently the start of a restructuring process at least two trustees promised Monday was on its way. But there are some questions about why the personnel actions were not reported publicly.

In an e-mail sent to teachers Tuesday afternoon, teachers' union president Sue Kenmotsu told members that she now recognizes the actions as the beginning of the restructuring mentioned by trustee Bonnie Cassel at the beginning of the meeting.

"We wonder why these decisions, taken in closed session (Monday) night, were not described to the public at the time of the report," she wrote.

But Jones said he did not want attention drawn to the employees, since both were at the meeting.

On Tuesday, Douglas said he was made aware of the possible reassignment Friday afternoon. "I understand that, because of the budget crisis," he said.

"We'll move forward. Whatever the outcome may be, I will continue providing support services to the students of Lodi in whatever capacity I am employed," he added.

Douglas is currently the second-highest ranking district employee. Atterberry, who currently oversees secondary education, could not be reached for comment.

The decision regarding Douglas was approved unanimously, while trustee Ken Davis voted against the Atterberry resolution.

Later in the meeting, Cassel was the lone dissenter in a vote that laid off 246 teachers. But prior to the discussion, both she and trustee Calvin Young more than once mentioned restructuring the district office, something constituents publicly called for at a series of town hall meetings held last month.

"We are going to restructure this district, and scrutinize every dollar because we must," Cassel said to a round of applause from the audience.

After more than two dozen teachers, parents and students spoke out against the cuts, Young, too, mentioned restructuring and even referring to the act in the past tense.

Jones said Tuesday that the board is headed toward further restructuring and will hear a report from Superintendent Cathy Nichols-Washer next month regarding her recommendations. She was out of the office Tuesday.

"We recognize that these actions are the beginning of the restructuring, but it doesn't address the cell phones or other things. We're talking a $30 million deficit," Kenmotsu said before adding, "Teacher-wise, eliminating Odie Douglas' position would bring back two teachers at the going rate."

The legality of Monday's board action has been questioned.

Open meeting laws dictate how items on closed-session agendas must be described, and Monday's may have been insufficient.

If there is a planned discussion regarding public employee appointment, employment or evaluation, the specific position title must be listed. Only if a public employee is being disciplined, dismissed or released can the title be omitted.

Monday's action was listed as: "Public Employee Appointment / Employment / Discipline / Dismissal / Release / Reassignment / Non-reelection: Management / Certificated / Classified; Public Employee Resignation: Management / Certificated; Public Employee Performance Evaluation."

At the beginning of the open session, when Jones reported what happened during the closed portion, all he said was that action was taken regarding two administrative positions. Typically, he names the affected position and often the person who currently holds it.

"If it's a bad call, then I take that fault," Jones said Tuesday afternoon.

With both Atterbery and Douglas present, he did not want to "call them out" by reporting by job title the board action taken. "With all due respect, we have these two employees sitting in the front row. I was not going to do what I have done in the past," Jones said.

Kenmotsu also questioned why the board did not report in open session the action taken in closed session. She said there was nothing to indicate what trustees did behind closed doors.

"We were there. We were all there," she said.

Jones said there was no intention of hiding the information. "I knew the media was going to call, and it was going to get out," he said.

There is a chance Douglas could leave the district since, he said, the next stage in his career is becoming a superintedent. "I am aware of the Stockton position and am definitely giving that much consideration," he said, adding that he is exploring all options. "If something comes along that I might be interested in, I will definitely consider it."

Douglas' position and the duties of his office have been questioned publicly before. According to the district website, the associate superintendent's office provides leadership to pre-kindergarten through 12th grade and the adult schools through assessment, research and evaluation; curriculum and instruction; and technology services.

Atterberry currently provides support to the district's high school principals and their staffs.

    yourkidding: You are correct, Rich was over 9-12 and brown was K-8.Where Pennington and Odie came ito this is beyond me!They created some positions in the last 5 years or so.It used to be only those two and 1 Supe.They ran the show, I think if there are so many that we get confused then there are too many!

    blossomBarbara Johnston took over after Dr. Brown. They both held the title of Asst. Sup of Secondary Education, which is your middle and high schools. Bill currently holds this position. Catherine Pennington has been in her postion for quite some time, She is the Asst. Sup of Elementary Eduacation. Rich Ferrera held one of the two titles mentioned above before he was promoted to the Associate Sup position-which Dr. Douglas currently holds. LUSD has ONE Associate Sup.

    Many of them are jumping ship as we speak! Everything is "Off" the Record but, of course!Their are a few who can't let go of the power but,if they stay it is gonna cost them $$$.They can't let that happen.     Mia- I am just glad that the some of the others who kept book an everyone have either retired or got promoted to that schhol district in the clouds. There are a few retirees who are still in the thick of things. They just can't let go of the "power" they think they have. You would think they would retire and have fun? Instead the gossip machine is well oiled and running full bore. Gossip central is actually in the ESC!

    Mia- Good call. I am a woman and know several of the so-called LUSD big shots through other business connections. I have no contracts with any government organization, but am in the middle so to speak and listen to them tell me how important they are and what they really believe---off the record. But I am not in debt to them and freedom of speech is more important. My opinion is that many of them are like invertebrate land animals. The kind I stick on a fishing hook.Piles? Makes no sense.

    Check out the retirement system for pensions. Casanega monthly $15,977, Ferrara 9,228. All past Adm. with LUSD. This is public knowledge. Freedom of Information Act Cal. Public Employees Retirement System. So the title is nothing, it is what these adm. are costing the district today as they build for their future. Remember the "Supe's" search that gave Casanega his boost at retirement. These are not CEO of a company, these are individuals that are using our money to run the district to educate kids. It should be reversed, the teachers are doing the work.

    Vickster and Mia - The only thing that matters is that the tax payers have to pay for this VERY expensive concierge service to Dr. Cathy. The only function they have is to provide one more layer of eduocracy, less work and a two more loyal soldiers willing to take the blame when requested. One side benefit for Dr Cathy, is a personal concierge service like at a hotel. Don't forget to leave a mint on the pillow.

    Never Happy- I called a friend to confirm, Yes, LUG as well as BUG are operative terms used by faculty and students at Wellesley. Undergraduate women are shamed into feeling guilty about being heterosexual so they experiment while they get rewarded with grades until they graduate. After graduation most return to their heterosexuality and some actually have children. Its the WOMENS center at this college which has a worse reputation that invented SEED. SEED was orginally designed as a study for special education students, and they redefined special education to a sexist and racist definition. Racist in te oure sense of the word and sexist in the pure sense of the word ie including hatred for non people of color and hatred toward males. It sounds very NON-ACADEMIC as well as anti-intellectual and SEXIST to hate 50% of the human population only because they have a Y chromosome.They give special dispensation to any male not white. Ergo, Odie and company meet the biological requirements.

    Too bad that LUSD has been allowed to lose it's prestige by no accountablity of qualifications and merit, instead playing the ethnicity card every time!Can anyone talk about the money saved by not employing all those laid off from July 1 to July 26, also consider these people will have no med. benefits until Jan. 2011! District won't pay how much per month for those six months???? Stop the games already, you're ruining our community and kids.

    Dr. Rich Ferrera was probably an Assistant Sup at one time. He retired from the Associate Sup position.

    This is the problem with what the board has done. They have left everyone guessing. That is wrong. The Board works for the public, and I believe they have a duty to disclose the financial impact of this decision. This kind of behind the scenes scrambling does no one any good, especially them. Even if the did something good, i.e. cutting some of the excess, it is lost is confusion. No one knows what, if anything, they have really done. No one knows if the secrecy (expecting the media to get the info to the public) is indicative of some larger suspect dealings; No one understands why hundreds of employees are cut in public and a few given special treatment. This could and should have been avoided. It is likely that all the Board is doing is finally taking some action that they should have over a year ago, to make the best use of district money during these times. It's too bad they chose the path of destruction in doing so. If you are a Board member and you read this, provide the information. Clear this up. Please.

    Yikes: Odies Position was not created for Odie. He applied for the position when it became available and was hired. Dr. Rich Ferrera was there before Odie.

    Your kidding: Yes, Odie could move into another position with a lower pay OR he could not. I should have used the word "could" instead of "would". My point is, big deal, the district is "moving" these two people from their positions. One (Odie) should have been pink-slipped. ( I believe he started in 2005? ) His position was basically created for him by the Huyett administration. Get rid of him altogether...his salary would pay that of at least 3 pink-slipped teachers. With the trickle-down effect, district admin going down to high school admin, then high school admin going back into the classroom = loss of pink-slipped teachers.

    I do not believe there is a high school that would want him. Too bad for which ever school has to get him as their principal. So basically it sounds like he bumps someone who hung onto a job and it will spiral down until someone loses a job for him to take one. I think the public should be told if infact he is taking a pay cut. I do not think he will have to. Maybe we should cut another program or add a few more kids to a class to ensure he is STILL OVERLY PAID.

    OMG Odie has a credential and a degree? How did that happen? I know there have been principals without a teaching credential, and some old timers were not able to keep their credentialds because the couldn't pass any of the tests. But this makes me wonder just what the hey is going on. No wonder there are so many poorly qualified single subject teachers...they don't have degrees (except for our own Odie), instead they have credentials. It sounds so important. Don't be impressed. They are very easy to get. If you are warm, you are qualified. Disgusting! What happened to excellence? Honor? If you cheat at the top, what do you think the underlings think about you?

    Yikes: Just because Odie is reassigned at the District Office does not mean he will keep his current salary. He will take the salary of Bill's position. But..remember...it's based on credentials. He might make more or Less then Bill. Just like when Dr. Barbara Johnston left. Bill took her job, and I believe he makes less than Barbara did while she served in his capacity. They say he will take Bill's position: If that is the case, then Bill would go back to a site as a Principal. I would think he would bump the least senior Principal at a High School. The bumping would continue and someone will be out of a position. I believe it would save the district approximately 164,275.00 a year, plus whatever his Secretary makes. I am guessing 60,000 a year?

    The district is just posturing if you ask me. If Odie Douglas and Atterberry are "reassigned" to another position in the district it could very well be AT the district office. This means they would retain their current salary. The district has a decades-long history of dishonesty....this is nothing new and shocking.

    Edumacation you are right about the Ed.D degree and it being a discount Ph.D I have no respect for anyone that insists on the title of "Doctor" in social situations with that degree. Odie flaunts it. The SEED program is a joke and it was used to flail us all into false guilt for our own ethnicity. Remember he was just a band kid out of Franklin High in Stockton that somehow made through the government maze and you nailed. He rode Huyetts coat tails into LUSD. He has done nothing but create animosity in this District.

    Mia- Is it true that Atterberry has chapped lips? It looks like he might learn the lesson that you can be a sycophant and shine shoes, cars, and just generally grovel around and it is never enough! Now he has been re-organized downward in the POS future employers will always wonder if it was because he wasn't loyal enough . Maybe its time to put on some lip gloss and keep on kissing up? Or is it time to act like an adult and be a whistleblower on the partyville on vine street? I wonder if he had the $1200 Taco Bell order? Or was that for another fast food joint? Is the ESC like a den of vipers that eat their own young?

    This is not right. All of this should have been brought to the front by the Board. So now, they are working in secret. Here is yet another thing that they are forcing the public to work though on their own. This is a public matter, and this type action will only lead to further distrust. We are going to have to dig into this.

    Any one making $164.275 a year, according to my calclator brings in close to $13,700 a month. In three months he brings in more than I do on SSI in a year, wish I had to struggle along with $164,275 a year, even half would be fine with me. Over worked maybe, over paid without a doubt.

    Most, Administrators are District "yes" people.Not all for sure but, the magority are so the District could do anthing to them and they would say " Yes, Sir/Mam"For fear of falling out of Grace : )

    Antivirus, I believe that is true of teachers, not of administrators. A case in point would be Ann Checcetti. She did not get to keep her salary level when going back to the classroom.

    If an administrator is not notified by March 15th that their position is eliminated, they retain their current salary in their new position. They are just moving these two guys around at the same price. The old bait and switch.

    This position was a invented by Engineer Bill Huyett who brought Odie to us so that he could do social engineering with the SEED program that told teachers that they were defective if they were not a "person of color". Remember the thousands spent on indoctrination "training" of teachers to make them feel guilty about being who they are. The invention of the "invisible backpack" of white unearned privileges. I saw a photo of "the Odie" with a smirk on his face as he smiled for a group photo with other radical activists for the Lesbian feminist designed SEED project at Wellesley college. It looks like this caper finally caught up with him? His job was a political plum that Superintendent Huyett gave to a loyal supporter from Elk Grove Unified.What is surprising to me is that I have met Odie and he doesn't impress me as someone who actually has a doctorate degree. Really now! It must be an Ed.D degree, there is no other degree that has low standards. I found one you can get online in your spare time. Very impressive!
