A man who is facing felony charges for allegedly raping a 13-year-old girl at Kofu Park appeared in San Joaquin Superior Court on Monday afternoon.
Donald Mack Bush, 26, is facing charges of lewd acts on a child and raping a drugged victim.
The court hearing was postponed on Monday because Bush was being assigned to a different attorney.
Bush was arrested after he reportedly lured a 13-year-old girl into a bathroom at the park and had sex with her on Sept. 25, Officer Shad Canestrino said. The girl met up with Bush and another 23-year-old man around 6 p.m., and started drinking and smoking marijuana with them, according to police.
After several beers, Canestrino said, Bush took the victim into the women's restroom at the park and locked a stall door.
When they came out, skaters at the park who witnessed the act stood up to Bush and chased him to Lodi Memorial Hospital, Canestrino said.
He was arrested inside the hospital's waiting room around 6:30 p.m., according to police records.
Bush was contacted by police officers in the hospital and Canestrino said he later confessed to having sex with the victim, but said he thought she was 17 or 18.
He is being held on $500,000 bail and will be back in court on Oct. 24.
