City of Galt named in liability lawsuit

The city of Galt has been named in a lawsuit filed by a Sacramento County resident against the California Department of Transportation and the county, for injuries the plaintiff suffered in a 2012 motorcycle accident on Highway 99.

Nelson Miller, whose city of residence was unavailable, claims in the lawsuit that he was driving a motorcycle north on Highway 99, roughly 500 feet north of Simmerhom Road, when he struck a 3-inch or more ridge from prior paving and/or grinding, causing his motorcycle to slide out from under him and resulting in severe bodily injuries, according to online court documents.

Miller claims in the lawsuit that there was no warning of the potential danger and is suing for general negligence.

Miller’s wife, Jenna Miller, is also a plaintiff in the lawsuit. They are not seeking a specific monetary amount, and instead are attempting to recover his medical and related expenses, lost earnings, and mental, emotional and physical pain and suffering.

The matter is set to be heard in court in February.
