A former vice principal is suing Lodi Unified School District for what she considers wrongful termination.
Lurdes Rosales was fired from her position as vice principal of Lodi Middle School in June 2012, following a controversial incident involving Rosales and physical education teacher Jon Lapachet in December 2011, according to her lawyer, Israel Ramirez.

Sorry if MY opinion of the "teacher in question" differs from yours, Mr. Scott.
You have no clue what different interactions teachers have with various students and their parents. It seems you are a pal of this teacher.
I really do not want to get into detail of my interactions with this person - over 10 years ago - but I doubt very much that YOUR experience was anything like MY experience. Bullies respond differently to men than they do to women, i.e., try to intimidate and convince one that their child is lazy, dumb, fat, or whatever other descriptive is used. When 5 other teachers have nothing but positives and 1 has huge negatives, one must wonder why.
And you are trying to convince me that parents don't like him because he gives their student a passing grade when they don't deserve it? Makes absolutely no sense - you are claiming that parents know their kids are slackers and then question a passing grade in PE. You must be kidding me!

Joanne, you're right (sarcasm). "The teacher in question," uh he was named in the article, Mr Lapachet, was not going to be intimidated by a woman trying to make a name for herself. She alienated staff by trying to use an iron fist. The "problem" in my opinion, is that LMS has one of more vocal staff of their union rights. Several are very outspoken.
Mr. Lapachet is not a bully. Sure, some parents don't like him. Why? Probably because he would "give" their child a passing grade in PE when the student did not put out an effort. And let's get this straight, it's not about being a good athlete, it is all about being on time, doing the jumping jacks and push ups, and participating in the various activities (archery, tennis, basketball, etc).

I wonder what ms.rosales had been and was doing in order to merit a response from a teacher such as she received. She brought on her own problems on herself. You could consider it 2 definitions of "blowing the whistle"in this case. Justice was served.

Why does everyone immediately assume that a person who works for the school district is a union employee.
Most administrators are not - why would Ms. Rosales sue her own union?
And would it surprise this commentor that thousands of "at will" employees sue their private industry employers for wrongful termination?
This incident obviously has a lot of issues that have not been publicized. And having had contact with the teacher in question, I would not be surprised who the "bully" was in this case.

Jason's point needs to be emphasized again: "As my second child is now moving through Lodi Middle School I could not be happier with the new administration in place who truly care about the children. "
LMS has not had an outstanding Principal in a long time. Scott McGregor has a stellar reputation from his years at nearby Vinewood, and is respected by the staff. Positive communication is key!

Obiously Ramirez has no idea about the different kinds of bullying that can go on. Physical bullying is just one part of it, intimidation, harassment and emotional bullying is much more common. Bullies come in all shapes and sizes and can often lash out at people bigger than them.

As my second child is now moving through Lodi Middle School I could not be happier with the new administration in place who truly care about the children. Clearly this person sought out conflicts and created much of the problems she encountered. We need to make it easier for schools to rid themselves of people who do not want to be there and have lost sight of the reason they wanted to teach our children in the first place.
