A Lockeford-area couple has withdrawn their appeal of a dog rescue kennel that temporarily houses dogs at risk of being euthanized.
The Dog Spot Rescue on Atkins Road operated without proper county permits for more than two years, according to county planners.
The San Joaquin County Planning Commission approved a use permit for Bill and Kate Montgomery on Jan. 2.
Neighbors Paul and Tracy Matheson appealed the approval in March, saying the dogs from the kennel bark throughout the day and night, making it hard for them to sleep.
The Mathesons, who live 200 feet from the Montgomery property, sought an injunction, which would have forced the Montgomerys to cease operating their kennel.
But the Board of Supervisors announced during Tuesday's meeting that the Mathesons withdrew their appeal, allowing the kennel to continue operating.
The Montgomerys said they're relieved the dispute is over.
“We're absolutely thrilled to have this behind us,” Kate said.
She added that the use permit requires they build a bathroom at the site, so they're currently in the process of raising roughly $10,000.
