Judge sets aside lawsuit filed by Galt cafe owner

A lawsuit filed against the city of Galt and its police department has been stayed due to a related criminal case. The decision was signed by a judge last week.

Peng Fei Lin, who operated the Lucky Internet Cafe, filed the lawsuit earlier this year in an attempt to save electronic devices he felt were illegally removed from his business by police and the Bureau of Gambling Control. However, officers have claimed the devices are evidence of an illegal gambling operation seized during a January bust.

The deputy district attorney handling the criminal case has indicated the criminal case will resolve the issue regarding whether the property may be destroyed. Moreover, because the property at issue is evidence in the criminal case, the police department will not be disposing of any of the property seized, according to online court records.
