A fight between two men over a woman seemed more fit for the MGM Grand than a Costco parking lot in Lodi on Sunday. But regardless of the setting — and despite the absence of Mike Tyson and Evander Holyfield — someone lost an ear.
Esteban Zapata, 38, of Lodi, and James Boco Jr., 39, of Stockton, got into an argument near the gasoline pumps around 1 p.m. at Costco in the Reynolds Ranch shopping center, according to Lodi Police Lt. David Griffin. The dispute was over a woman who was the ex-wife of one of the men, Griffin said.
The argument turned physical, and according to witnesses, while both men were throwing fists, Zapata bit off a piece of Boco’s ear, Griffin said.
Lodi police officers arrived and both men were given medical attention. Officers cited and released Boco at the scene, while Zapata was arrested on suspicion of mayhem, a charge Lodi police rarely use, Griffin said.
According to the penal code, mayhem applies to anyone who “unlawfully and maliciously deprives a human being of a member of his body, or disables, disfigures, or renders it useless, or cuts or disables the tongue, or puts out an eye, or slits the nose, ear or lip.”
Zapata is currently being held in San Joaquin County Jail on $100,000 bail. He’s scheduled to appear in San Joaquin County Superior Court on Wednesday.
