Michael Kelly civil trial may go to jury Friday

The civil case against Father Michael Kelly may go to the jury for deliberation by Friday, according to attorneys involved in the case.

Kelly, priest at St. Joachim's Catholic Church in Lockeford the past eight years, faces a lawsuit by a 37-year-old man who says that Kelly sexually assaulted him when the plaintiff was about 10 years old at Cathedral of the Annunciation in Stockton. Kelly has not been criminally charged in the case.

The plaintiff's identity is being withheld by court order because he is potentially a sexual assault victim.

Attorneys will spend this morning discussing jury instructions with Superior Court Judge Bob McNatt before open court resumes at 1:30 p.m. Attorneys John Manly and Vince Finaldi, representing the plaintiff, are scheduled to call additional witnesses to the stand today.

Depending on how long the witnesses testify, final arguments by attorneys for the plaintiff and both defendants — Kelly and the Stockton Diocese — will begin as early as this afternoon, according to Tom Beatty, Kelly's attorney. Otherwise, arguments will begin Thursday morning.

The courthouse is at 222 E. Weber Ave., Department 24, fourth floor, Stockton.
