We need tort reform

Saturday, November 7, 2009 7:20 AM PST

The most transparent and ethical administration in history? With all the tax cheats and radical leftist czars accountable only to Obama?

Is "change" enacting monstrous 1,000-page bills that our elected representatives can't read before voting? The Baucus Bill has to be melded and reconciled with five bills. All behind closed doors — Republicans not welcome. So much for the bipartisan approach, transparency, and the five days to view a bill before signing that Obama promised on May 9. With the enormity of the issues involved, we need a full, bi-partisan debate.

Republicans have been accused of not having a health care plan. Why, if 85 percent of those with health insurance like their coverage, do we have to upend the whole system at horrendous expense (when we are already drowning in debt at all levels of government)? Some of the proposals by Republicans that would effect real savings would be tort reform so doctors could afford liability insurance. My nephew's practice gave up delivering babies in a small town in Iowa. Women had to go to a neighboring town 25 miles away to have their babies. The doctors couldn't afford the malpractice insurance. (But, no, that would impact on the lawyers who donate heavily to Democrats.)

Buying insurance across state lines means more competition between companies and portability of insurance — the insurance contract belonging to the individual and the individual being able to deduct costs on his income tax return means the worker doesn't lose his coverage when leaving a job.

Covering illegal aliens is not really a factor because the Immigration Bill would give them legal status within 24 hours of applying, no back taxes, English not required, tuition for illegals, eligible for Income Tax Credit, and the estimated 30,000 illegal gang members would be eligible.

In the same period of time in office as Clinton and Bush, they each made 40 some speeches; Obama made over 120. Doesn't he know he won the election? Quit campaigning and govern.

I assume you are not including Chicago politicians in your fictitious study.

"Democrats must obey the law more often..." What? "

I'll vote for that! "

" Lawyers fight tooth and nail for their clients. They only get what the law allows. If they donate heavily to Democrats, it is likely because Democrats are more trustworthy than Republicans. Statistically, Democrats must obey the law more often because the number of republican politicians in jail far exceeds the number of Democrats.

What we need to reform and eliminate is Hate, especially from self-righteous republicans. "

" Stella, maybe that is the problem. Maybe the federal courts need more influence over local malpractice laws. "

" Great letter, Phyllis. Other than the people that are still infatuated by this farce of an administration, you speak the minds of many intelligent Americans that see right through this sham. "

" Tort reform cannot be enacted with Ms. Roche's intended effect at the federal level, because malpractice laws are controlled by the states. Each state's legislative branch would need to enact such limits. "
