Lodi teacher Andrew Krienke arraigned on 3 counts of statutory rape

A Lodi High School teacher was arraigned Friday on three felony counts of statutory rape relating to his relationship with a former student.

Andrew Krienke, 35, did not enter a plea at the brief court appearance, which was attended by the alleged victim and their 6-month-old child.

Krienke remains out of custody on the $15,000 bail he posted shortly after his July 30 arrest, and he will return to court Sept. 17.

His attorney denied allegations by Lodi police that Krienke had started a sexual relationship when he was 32 and the alleged victim was 17. At the time, she was attending one of Krienke's history classes, according to police.

"It is very unfortunate for all involved that false rumors at Lodi High School have misled well-meaning authorities and hurt my client," his Lodi attorney, Thomas Driscoll Jr., said after court.

"Both parties involved were consenting adults and both are adamant that a minor was not involved," the attorney added.

Deputy District Attorney Elton Grau said the victim was 17 at the time.

"There are rules that teachers should be abiding by. If you're a teacher, you should not have relationships with students for a sexual purpose," Grau said.

Police allege that Krienke had lived in an apartment a block away from school and that he and the student had sex there. There was no indication that sexual activity happened on school grounds.

Krienke now lives in Elk Grove. The alleged victim, now 20, lives with him and their baby. She also has a 3-year-old child.

Krienke, who taught at Lodi High since 2004, has been on leave from work since he was arrested. Lodi Unified School District officials did not return a message Friday regarding whether that leave is paid or unpaid.

I have yet to see any evidence that this teacher was tapping this student when she was 17. Obviously, someone was. But, not the teacher. I wonder if the father of the three year old is paying child support? "

" Andy is a good guy. I can't imagine he would begin this relationship before she was 18, but the truth is only he and she really know. I believe Andy is innocent and my heart goes out to him and his family for all of the heartache that has been caused. I hope that he will be able to someday move past all of this and be able to live his life. "

" To "getreal": How you feel about Andrew Krienke is your own warped reality, but why bring his father into the mix?! That was just wrong!! Seriously, uncalled for, and totally unjustified!
Teachers are always prosecuted in the newspaper before even seeing a courtroom. They VERY easy targets. All you have to do is hint at something being amiss, then let the rumor mill begin. Not long after, they are taken out of the classroom, and their career destroyed. And this is BEFORE anything is investigated. It doesn't have to be factual. It only has to be alleged. Sad. "

" The one who started "this mess" is Andrew Krienke,he is the one that bedded a minor. And Oakie Doakie -Andrew Krienke knows that he was inappropriate with more than just this one girl - and when I say inappropriate - I will remind you that just being too cozy with your students is inappropriate. He is immature and should be removed from teaching our youth. "

" Mr. Andrew Krienke is NOT the father of the girl's 3 year old, the real father's sister started this mess. SHE is the one who is guilty and should be prosecuted! Andrew Krienke is a good guy, an excellent teacher, and so is his father!!
The writer "getreal" must have been a real piece of work at Woodbridge. I can see him as some bitter, below average, loser. Sad. I'm sure he never had anyone pay attention to him in jr. high, but seriously,...being jealous of Mr. Krienke just because people actually liked, and RESPECTED, him.
Get over it little boy! "

" edumacation: Whereas I am very open-minded to acquittal, especially if he is not the father of the first child,

and I share your optimism hoping for a jury acquittal of NOT Guilty,

I cannot over-emphasize the danger of devious prosecutor tactics that are designed to save face.

The prosecution will be substantially embarrassed if they do not get a conviction, and their political status is more important to them than right and wrong.

Courtroom tactics and drama are not in Kreinke's favor. "

Em in the A**. It sounds like it’s hear-say and if proven a civil suit could
be in the works. Nothing has been said about a Grand Jury, why not.. That is
the prosecutions’ favorite tool though one sided it is.. Sounds like some DA
want’s a name for himself.. Now if that was my daughter and this had taken place it would have never gotten past the first kid. We would have had to see proctologist to get my foot out of that kids A**…. "

" Any one that opened their eyes could see what he was up to many years ago. Lets not paint the picture for anything other than it is, he couldnt keep a relationship with anyone his own age. He is not any different than his dad, who has been known to grade differently for boys than he does for girls. The first I heard of the family problem was about 10 years ago at Woodbridge Middle School - fortunately his dad just kept it to flirting. "

A poorly disguised retribution against his father for lawful union activities. Its an old case----if it even merits being a case. They are on an anti-family attack now. Imagine how much this fiasco will end up costing and how much misery for small town edu-politics.

WTF-- I have a question- I heard that the ESC is attempting to refinance those construction bonds. Other California districts who tried this scam are being investigated for fraud. Have you heard anything about it? "

" election year: Juries can be manipulated for anything. Juries can be impressed to believe that the sky is yellow, if that is needed to obtain a conviction.

Krienke is in very grave danger, even if the first child is his.

Recently I followed a trial with a friend of mine, and the prosecutor and judge were more interested in protecting their careers than truth. The defense lawyer broke down the first witness, and somehow the courtroom recorder got sick and could not enter her transcripts into the record for the jury to examine. On day 2, a substitute recorder continued, and the official court record began on day 2.

If the alleged victim were having an affair with another minor at the time that she was a minor, a jury can be impressed by the prosecutor for conviction anyway. "

" This whole incident has been manufactured by the sister of the girl's former boyfriend by whom she had her first child (when she was 17) while in high school. The sister made the complaint because she felt her brother had been wronged by this girl starting a new relationship and having a second baby with her new partner.

This man's career has been irreparably harmed by some little piece of white trash with a vendetta and a lot of time on her hands. She should be prosecuted for filing a false report. "

" As a male student in high school, all of my female teachers were not even close to being "desirable", at least not to me. When I wasin college, male professors and female students quite often had "conjugal visits" but all concerned were over the age of consent. A lot of female teachers now are a lot younger and dress more provacative than even a generation ago. Still no excuse to cross the teacher/student conduct rules. "
