Lodi teacher Andrew Krienke arraigned on 3 counts of statutory rape
A Lodi High School teacher was arraigned Friday on three felony counts of statutory rape relating to his relationship with a former student.
Andrew Krienke, 35, did not enter a plea at the brief court appearance, which was attended by the alleged victim and their 6-month-old child.
Krienke remains out of custody on the $15,000 bail he posted shortly after his July 30 arrest, and he will return to court Sept. 17.
His attorney denied allegations by Lodi police that Krienke had started a sexual relationship when he was 32 and the alleged victim was 17. At the time, she was attending one of Krienke's history classes, according to police.
"It is very unfortunate for all involved that false rumors at Lodi High School have misled well-meaning authorities and hurt my client," his Lodi attorney, Thomas Driscoll Jr., said after court.
"Both parties involved were consenting adults and both are adamant that a minor was not involved," the attorney added.
Deputy District Attorney Elton Grau said the victim was 17 at the time.
"There are rules that teachers should be abiding by. If you're a teacher, you should not have relationships with students for a sexual purpose," Grau said.
Police allege that Krienke had lived in an apartment a block away from school and that he and the student had sex there. There was no indication that sexual activity happened on school grounds.
Krienke now lives in Elk Grove. The alleged victim, now 20, lives with him and their baby. She also has a 3-year-old child.
Krienke, who taught at Lodi High since 2004, has been on leave from work since he was arrested. Lodi Unified School District officials did not return a message Friday regarding whether that leave is paid or unpaid.

I have yet to see any evidence that this teacher was tapping this student when she was 17. Obviously, someone was. But, not the teacher. I wonder if the father of the three year old is paying child support? "

Teachers are always prosecuted in the newspaper before even seeing a courtroom.They VERY easy targets. All you have to do is hint at something being amiss, then let the rumor mill begin. Not long after, they are taken out of the classroom, and their career destroyed. And this is BEFORE anything is investigated. It doesn't have to be factual. It only has to be alleged. Sad. "

I cannot over-emphasize the danger of devious prosecutor tactics that are designed to save face.
The prosecution will be substantially embarrassed if they do not get a conviction, and their political status is more important to them than right and wrong.
Courtroom tactics and drama are not in Kreinke's favor. "

Em in the A**. It sounds like it’s hear-say and if proven a civil suit could
be in the works. Nothing has been said about a Grand Jury, why not.. That is
the prosecutions’ favorite tool though one sided it is.. Sounds like some DA
want’s a name for himself.. Now if that was my daughter and this had taken place it would have never gotten past the first kid. We would have had to see proctologist to get my foot out of that kids A**…. "

Krienke is in very grave danger, even if the first child is his.
Recently I followed a trial with a friend of mine, and the prosecutor and judge were more interested in protecting their careers than truth. The defense lawyer broke down the first witness, and somehow the courtroom recorder got sick and could not enter her transcripts into the record for the jury to examine. On day 2, a substitute recorder continued, and the official court record began on day 2.
If the alleged victim were having an affair with another minor at the time that she was a minor, a jury can be impressed by the prosecutor for conviction anyway. "
