Court appearance for 2 charged in heat death

By News-Sentinel Staff

Two people charged in connection with the May 2008 heat-related death of a Lodi farmworker made their second court appearance Thursday.

Maria De Los Angeles Colunga and her brother, Elias Armenta, will return to court Sept. 17. In the meantime attorneys will give each other more evidence, said San Joaquin County Deputy District Attorney Lester Fleming.

De Los Angeles Colunga, owner of now-defunct Merced Farm Labor, and Armenta, the company's safety coordinator, face involuntary manslaughter charges in the death of Maria Vasquez Jimenez. The 17-year-old girl collapsed May 14, 2008, in a Farmington vineyard during a heat wave, and died two days later at Lodi Memorial Hospital.

A third man charged in the case, foreman Raul Martinez, didn't appear at the initial May 5 arraignment, and did not appear Thursday.

As of Thursday, a warrant had yet to be issued for Martinez's arrest.

The state shut down Merced Farm Labor soon after Jimenez's death, and issued fines of more than $262,000 for failing to follow heat safety laws. California requires that employees working outside be given water, shade and training about heat illness.

De Los Angeles Colunga and Armenta, of Atwater, are out of custody on their promise to appear in court.
