CHP: Road rage leads to Highway 12 crash

Passenger receives major head injuries

An apparent case of road rage and high speed left a man with life-threatening injuries after a Friday afternoon crash on Highway 12 east of Tower Park Marina.

The crash caused traffic to grind to a halt until the highway could be cleared at around 5:21 p.m.

At 4:19 p.m., Ceres resident Ismael Gutierrez Gonzalez, 26, was driving a Honda Civic east on the two-lane road at about 75-80 mph, said California Highway Patrol Officer Adrian Quintero.

The 1997 Civic began driving on the shoulder to pass another car, and witnesses told investigators that a passenger was leaning out a window and making hand gestures at the other car, Quintero said.

Gutierrez Gonzalez lost control on the shoulder, overcorrected and came to rest facing south in the westbound lane.

An oncoming 1999 Ford Econoline van was driving west around 50 mph when it reached the Honda. The driver, Pablo Soria, 26, of Winters, braked but couldn't avoid hitting the rear part of the Honda, Quintero said.

The Honda's rear passenger, Carlos Garcia, 31, of Modesto, received major head injuries and was taken by ambulance to San Joaquin General Hospital. Investigators do not believe he was wearing a seat belt, partly due to the witnesses who said Garcia was leaning out the window, Quintero said.

The van's driver was not injured. His passenger, Jaime Soria, 19, also of Winters, had complaints of pain.

Ismael Gutierrez Gonzalez, the Honda's driver, had complaints of pain, as did his front passenger, 31-year-old Hugo Gutierrez, of Modesto.

The crash came one day after a San Joaquin County jury reached a verdict in a case involving a head-on collision not far from the same spot.

In that case, the jury voted 11-1 that the California Department of Transportation was not responsible for the condition of the road. An attorney for that victim, Alicia Schmid, had argued that Caltrans knew the road was unsafe and should have installed more safety devices in the median. The state argued that the blame was the entire fault of the other driver, who fell asleep at the wheel and crossed into Schmid's lane.

Friday's crash was "a classic case of road rage and speeding," Quintero said.

Passing is not allowed on shoulders, and the speed limit on Highway 12 is 55 mph.

" President Obama just indicated today a new public works projects program is coming soon. This is our BIG OPPORTUNITY to get SR12's upgrade on the "A" List. We need to find out how we can lobby to make this happen. Ideally, a 4-lane divided freeway with 3 new bridges. If not that- at least a fixed barrier wall like that installed on SR37 which has TOTALLY STOPPED all head-on collisions since it
was implemented. Let's make it happen! "

" The driver was so reckless. I'm really surprised there was no drug/alcohol testing done, even if it is just to make sure the test results are on record. "

" Layla

Thank you for your response. I just thought with an accident such as this that testing would be SOP. "

" Actually, its fairly clear that the "passenger had major head injuries" BEFORE the crash. The driver, too! Let's hope the Lodi News publishes follow ups on this article so we can learn more about these idiots. Keep the pressure on, folks- maybe SR12 improvement can be in the "New WPA"
that our new Administration will likely be implementing soon. Let's hope so. Its about time we used OUR taxpayer dollars to fix OUR crummy roads and infrastructure ...instead of Iraq's! "

" OTH: Good question on whether alcohol or drugs were factors: The CHP said they did not appear to be involved. (My fault; I left out the line at the end of a rather busy day.) "

" Hey there Reality1- I think you get my point here: Lodi is a really nice little town with a lot of worthy goods and services. And there is a lot in Stockton, etc, too. But that means I have to take
"Blood Alley" to and from...maybe even after sunset (ever drive SR12 into a rising or setting sun? ...Horrible). Its just not worth the risk, to me. Most SR12 drivers are "destination-driven". They are not locals and do not have a "Delta" mentality. They just want to get from Point A to Point B....FAST! With me going 60 tops, I'm just an obstacle to harrass, tailgate, and pass- or worse. So why go through that hassle? I just go elsewhere where there is not so much pressure and stress..not to mention risk. I'd LOVE to visit Lodi & Fairfield more, but..... "

" To jramagic
FYI there is no Home Depot in Lodi and when I built my house I dealt with Foster lumber and other locals and got free delivery at competitive prices. Didn't have to drive any roads. "

lodiBorn wrote on Nov 17, 2008 11:32 AM:

" jrmagic, how long have you lived in the RV area? Long enough to have had drivers' training ON Highway 12 between Lodi and Fairfield? I have to agree with your going to Brentwood to get building supplies, especially if you are going to take them home yourself. 10 years ago I bought a mirrored door at the Pittsburg Home Depot only because the road was smoother compared to 12...yes, bridge toll and higher sales tax was well worth avoiding having to buy in SJ County. "

jramagic wrote on Nov 17, 2008 9:47 AM:

" Lodi has a Lowes and a Home Depot and numerous furniture stores. When you build a new house -as I did- one spends a lot of time shopping and buying a lot of stuff.
I would have loved to have shopped in lovely, convenient Lodi...but because of that crummy road, I did most all of my shopping in Brentwood, even though I had to pay bridge toll. And that will continue, until SR12 is fixed. I imagine others may feel the same. "

elsewhere just because of that. In fact, during the last 2-3 years, I spent $150,000+ elsewhere... because of that crummy road"
Dude I doubt highly if you would have spent that much in Lodi. Not enough shopping or eating going on here.
For all of you sue happy people get over it. It is not the roads fault this accident happened. "

" Hey- I cruised out of the Rio Vista area this weekend for a nice day shopping, eating, etc. Guess what? I didn't spend a DIME in Lodi. Why? No way I'm going to take my chances on that Blood Alley suicide road. Nope...I spend my money
elsewhere just because of that. In fact, during the last 2-3 years, I spent $150,000+ elsewhere... because of that crummy "road". And that will continue until it is made safe with a barrier. Sorry Lodi- you are such a lovely little city that I'd love to enjoy. I'll bet I'm not the only person who feels this way. "

" One day, I was passed by a speeding car full of insane meth-heads (a popular local pastime) going down the CENTER of SR12!
That's right...the CENTER! The road was crowded in BOTH directions...everyone had to hit the shoulders to let these death-freaks pass. I called 911 immediately...but it took no less than 20 minutes before they finally got around to taking my call. So forget help from the CHP. We need a BARRIER and need it STAT! Only a BARRIER will give sure protection 7x24!! Please consider YOUR loved ones driving this crummy overused road and push for a BARRIER! "

jramagic wrote on Nov 17, 2008 7:03 AM:

" Well, here I go again...writing my ZILLIONTH blog...pushing for a dividing barrier on SR12. I expect the usual reactions: "its the driver's fault, not the road", etc, etc. This latest collision is typical: A carload of half-witted idiots breaking the law, raising hell, terrorizing some driver likely doing the speed limit. Probably meth-heads, likely many other bad things too. If there has been a barrier- there would have been no accident. It could have been YOU or YOUR loved ones in that Econoline...and here comes the Honda on YOUR side of the road. Its time to ELIMINATE the OPTION of "passing" by installing a barrier. I hope more victims sue Caltrans for negligence AND WIN!!!! "

" I'm sorry if this sounds heartless but those idiots deserved everything they got. Too bad the driver of the van and his passenger were hurt. There is no amount of concrete barriers that can legislate away stupidity. They were probably illegal aliens and you can bet that we (taxpayers) will be left holding the bag for their medical expenses. Can anyone say...deportation???? "

" Sounds like another narrow miss head on collision that could have been avoided completely if the highway had a center concrete barrier. At least the morons in the Honda took the brunt of the damage they caused.....this time. "

Mrs. S. wrote on Nov 15, 2008 1:33 PM:

" I think this is actually another case for cement lane dividers. The damage that moron caused would be limited if he hadn't landed in the westbound lane in front of the van. I wonder if the man with the head injuries was the one making the gestures? "

OTH wrote on Nov 15, 2008 8:48 AM:

" Nothing was mentioned in the article about drugs or alcohol, hopefully he was tested if not jailed. Hiway 12 is unsafe but all the money in the world can't keep this type of incident from happening. As long as mental deficients like these two are allowed on the highways.

The victim may not sue but you better believe we are paying for his medical bills as well as his passenger. "

" Its too bad that the driver of the honda didn't drown in a ditch after the crash. 12 would be much safer with a-holes like him off of the road.
Will the victim sue the state as well? "
