Barbara Payne cited for watering lawn of abandoned home; city says water connection could have led to 'cross contamination'

Two weeks after Galt City Council members urged the public to help keep up abandoned homes, one of them has been fined $100 for doing just that.

Barbara Payne received a citation from the city's Public Works department last week for watering the lawn of an abandoned home next door — a violation of the city's code.

Payne said she and a group of about five neighbors had been watering and cutting the lawn at 121 Silver Spruce Court for the past month to prevent the foreclosed home from becoming a neighborhood eyesore.

"I have to say it wasn't a good feeling," the councilwoman said of finding the citation stuck under her doormat last week. "If you're trying to do something good, why should you be fined for it?"

Galt Public Works Director Gregg Halladay said Payne's case wasn't just a matter of sprinkling a bit of water next door — which is "technically" a violation in itself, he noted.

A hose had been hooked up from the outside faucet of the Payne household to the outside faucet of the abandoned home, allowing neighbors to manually turn on an existing sprinkler system at the abandoned home.

The connection, however, created the potential for "cross contamination of the water system," the director said.

Should a drop in water pressure have occurred — say, from a fire hydrant being used — mud, insects or stagnant pool water could have been sucked up from the abandoned property and funneled into the Payne's home or into the water system itself, Halladay said.

A regular check of the water system found no such contamination, he noted.

Halladay said a public works staff member noticed the connection during a "vacancy check," made to ensure the abandoned home's water was shut off.

Council members at their May 20 meeting, including Mayor Andrew Meredith, told residents to take matters into their own hands to fight foreclosure-related blight, following public comments about abandoned properties popping up in Galt.

Meredith said Monday he stands by those words of encouragement. He just doesn't want to see residents do what Payne did.

"She made an illegal connection — she trespassed onto her neighbor's property," said Meredith, who has clashed with Payne on numerous occasions over city policy.

He noted the connection could have provided water pressure throughout the abandoned home, and potentially flooded the home.

City Manager Ted Anderson at the May 20 meeting had suggested residents contact Galt's code enforcement officers regarding blight.

The Galt Municipal Code, Section 13.08.180, states "No person shall supply water from his own service to any other premise unless written authorization from the Director is obtained. The Director shall authorize such connection on a temporary basis only to facilitate repairs on the water system or for health and safety."

"We considered this health and safety," noted Georgeann Hornor, who along with her husband, Jack, helped keep up the abandoned home. "We didn't want people moving in there. Obviously, it's an abandoned house."

Payne said the matter is not on tonight's council agenda, but might be brought up.

The lawn at 121 Silver Spruce Court is now starting to dry out. Neighbors had hoped they could keep it from turning into a dead brown mass, full of thick weeds like other abandoned properties in the neighborhood.

"There were a lot of us trying to keep the place up," said Jack Hornor. "We're not now."

" The only way you could have operated that sprinkler system was to make a connection to one of the lawn sprinklers themselves in front of the anti-syphon valves, not at the hose-bibb behind the anti-syphon and on the house supply side of the water system. Why did it take you finally 3 days to make up yet a different excuse and why did they get the ticket and not offer the same explanation as you if he's the so-called PLUMMER? The sprinkler system operates from the same water supply as the hose bibb it was connected to, which also supplies the house water. You're story doesn't even hold water. "

" I was directly involved in this issue, so please let me explain how it all went down. My husband, Jack, and Barbaras husband were standing outside his garage discussing the fact that the lawn on the foreclosed home was starting to turn brown. Jack is retired, so he volunteered to water the lawn enough to keep it from dying if he could use the hose from the Paynes home. The hose wouldnt reach every place, so Barbaras husband, who is a plumber, said he would hook the hose to the other homes sprinkler system at their outdoor faucet. The water to the home had been cut off at the curb, so while a realtor was with him, he pressurized the system and went into the house to verify there were no leaks and no open faucets. The system was pressurized ONLY for the few minutes when he was watering. The sprinklers for that house all have anti-syphon valves, so no contaminated water could go into the Paynes home. After Jack was through watering, he turned off the water and bled the sprinkler system. The amount of water used was minimal. "

It cost me about 300 dollars, and a day in traffic school (which is 8 hours of your life you can't get back). This story has taught me a lot about Ms. Payne. What a publicity wh.........hound. You broke the law. By Barbara Payne whining about the fine, she is not showing the citizens of Galt (who voted for her) how to abide by the rules. I heard her on KFBK this afternoon (06/04) and she once again claimed that hooked up the hose to the vacant lot's sprinklers. It was in the spirit of neighborly conduct but she made a mistake. Okay - so it may have been an innocent mistake. Take the fine, learn from your mistake, learn your city ordinances, especially, if you are a member of the Galt City Council. " SHE LIED TO THE PRESS AND TO HER CONSTITUENTS!! Barbara was not innocently "watering" the lawn. She connected a hose from her house to the main water line on the neighbor's house. She did not include a backflow preventer. This creates a health risk. Providing water to the abandoned house INCREASES the risk of vagrancy. What the City Council encouraged was to take a sprinkler at the end of a hose connected to one's house and water the neighbor's yard, moving the hose and sprinkler around the yard. Finally, Public Works tried to give the citation to her but she was not home. They then left it at her door. This was not evasive maneuver as Barabara has the gall to claim. Sure, help keep your neighborhood looking good, but do it in a responsible manner. Oh, and if one gets caught doing something stupid, don't go to the press with misrepresented facts! "

I mean, hasn't Lodi had their water police out patrolling your neighborhoods for years? I can see the point during drought years, but they were put in place and kept there. Us Galtonians like each other, look out for each other, and try to ignore most of the shenanigans that happen at city hall. But this bunch we have now, may be the worst ever. " Saw Barbara's letter to the editor in the LNS yesterday and again, I'll say the banks who foreclosed on the properties should be held accountable for their upkeep once the homes are empty.

Something else to think about: We had minimal rain fall this past winter and more than likely, water rationing will be coming up this summer. Why waste the minimal amount of water you're allowed on an empty house? Make the banks accountable and fine them if necessary. "

" Looks like that little parking strip in that picture has dead grass at the end where a vehicle has apparently been parked and leaking automotive contaminants into the ground there. I'd be a little more worried about the cockroaches breeding in that vacant house than anything else. You may have even flooded the interior if someone came in and stole any appliance or fixture that was attached to the water supply or left a water tap on. You need to have the owner check to see if that indeed happen. If you flooded that interior there's going to be some pretty strong mold and mildew growth in there that you will be entirely responsible for. "

I watch the City Council meetings, it was a suggestion by Tim Raboy to go over and take care of your neigbhors yard, quickly backed by Mayor Meredith (as always!) that sent good neighbor Barbara Payne and her neighbors over to take care of the abandoned yard. Now the Mayor is on his high horse chastising Payne about tresspassing and cross contamination. Give me a break!! Refund the $100 fine. In the future, Councilmen,use more care in your suggestions. "

" Ok, Let's see. The Public Works Director was at the meeting when the board approved the fact that neighbors should help keep up adjoining properties. Why didn't someone (The Director) take the initiative to let the public know that there are certain things that do violate this approval. I will be honest I have been watering and mowing a lawn by hand on a local house that is empty in Galt. That has stopped effective today!!! To hek with the City. I request the Fire Department post all houses that are abandoned and the dead grass is over grown as a fire hazard. I will be sending a letter to the Fire Chief about this problem immediately. I do not agree with the way that Barbara and her neighbors did it but there intentions were good. Does it really surprise anyone that Andrew Meredith would bad mouth Barbara instead of standing up for his(and the Councils) decision. I think the Council should let all Galt residents know what they can and can't do because Meredith is already accusing Barbara of trespassing which they(the council) approved. How can you water and take care of a property without trespassing. Just thinking out loud!! Have a Great Day to All!! "

Hey Barbara, why don't you work on getting this city ordinance changed at your next city council meeting.
