Travesty of justice in Lodi will one day be rectified

Dr. Wen Ho Lee is a nuclear scientist who worked at Los Alamos National Lab analyzing and predicting the behavior of the cores of nuclear bombs during the process of explosion. Two days before Christmas in 1998 he was arrested by the FBI and his whole life was turned upside down.

The Justice Department filed 59 counts of espionage charges against him. After he was humiliated for 278 days in the prison, the judge said before his release: "I believe you were terribly wronged in custody pretrial in the Santa Fe County Detention Center under demeaning, unnecessarily punitive conditions."

The judge went on to add: "Dr. Lee I tell you with great sadness that I feel I was led astray last December by the Executive Branch of our Government through its Department of Justice and the FBI ... ."

Mr. Lowell Bergman is an outstanding investigative journalist who has done groundbreaking reports for The New York Times, PBS "Frontline," and CBS "60 Minutes," which have earned him every top award in journalism. His exposés of Big Tobacco (dramatized in the film "The Insider"), the Enron scandal, the roots of terrorism, and many others, have influenced legislation and court cases and routinely sets the news agenda nationwide. His PBS "Frontline" program "Enemy Within" which aired on Oct. 10, 2006, gives a clear depiction of what happened in Lodi since June 2005. It appears same travesty of justice which occurred in Los Alamos, N.M., in 1998 was repeated in Lodi last year.

The FBI arrested five innocent people and announced that they found an al-Qaida cell in Lodi. The people involved considered it to be a case of such major importance that President Bush was briefed on the Lodi terror cell and the Intelligence Czar John Negroponte briefed Congress on the arrests. Those who were close to the people who were arrested could not believe how a dreadful wrong can be committed by the FBI and the Justice Department.

The FBI later recanted its initial of bombshell claim of an al-Qaida cell in Lodi but the damage was already done. The news reverberated like a shock wave around the world on TV screens, radio and the print media.

After four years of wire tapping, on-site informants, and direct searches of premises did not reveal any evidence that there was any illegal activity in Lodi. So the FBI and Immigration and Custom Service produced an imaginary organizational chart that connected Hamid Hayat, a sixth-grade drop out, to Osama bin Laden through a network of intermediate connections. They found a two-inch square paper (taveez — an amulet) in Hamid's pocket that was mistranslated and misconstrued to convict Hamid Hayat. This is truly a travesty of justice.

The FBI and Justice Department played the media game of scaring the American people and the media ate it up. The scary news sells. In the end they let the "Big Fish" Imam Adil and Imam Shabbir go back to their home country of Pakistan because they did not have an iota of evidence of any wrong doing against them. Long before the arrest, on the behest of a well-paid informant, they made up their minds that these people were guilty. Any evidence to the contrary did not matter. What the FBI and the Justice Department did is wrong. In the process they destroyed the lives of innocent people.

All this was a fodder for the redneck hate-mongers of Lodi. They wrote letters to the editors and those who could not write settled for blogs on the Internet. Some of these hate mongers tried to intimidate Mr. Richard Jones, the well-respected CEO of the Lodi Boys and Girls Club. Mr. Jones, a gentle and caring man who has an impeccable record of love for the people and children of Lodi, was blamed for supporting the terrorists when he tried to help a man and his family who have been terribly wronged. All Mr. Jones did was to collect few hundred dollars from his friends and fellow workers to help a man to fix his ice cream truck so that he can support his family. The people who maliciously raised voices against this act of kindness knew fully well that Mr. Jones did not do anything wrong.

The derogatory comments made against Mr. Jones and others in the community are not in response to a single act or misdeed, but a deep-seated fear, resentment and hate against other people. This community has stood up against these hate mongers in the past and I am sure it will stand up against them in future. Using the words of a Lodian, I believe "the seeds of hate will find a barren soil in lovable and livable Lodi" and the wrongs committed by our government will be rectified one day.
